Overview

The village of Mukwonago, Wi. enforces the Uniform Dwelling Code, SPS chs. 320–325. The village also adopted the Wisconsin Commercial Building Code, SPS chs. 360-366. Mukwonago, Wi. Mun. Code § 18-26 (Uniform Dwelling Code adopted) (accessed 4/15/2015). The code of ordinances references Chapters 50-64 of the ILHR, Wis. Adm. Code. However, state mandate requires that municipalities adopt SPS 360-366 in its entirety. Furthermore, Sec. 18-26. Adopted by reference. – the provision states, “Chapters 21-25 of the 1993 edition of the Building Code, promulgated by the Southeastern Building Inspector Association, including all appendices, is adopted by reference”. Presumably, incompliance with state statute, the UDC is adopted by this provision.

The village of Mukwonago, Wi. enforces the Uniform Dwelling Code, SPS chs. 320–325. No online copy of the 1993 BIASEW Building Code could be found, so we are not sure if village alters or amends their building code in application to existing buildings.

Commercial Building Code

Mukwonago adopted the 2009 IBC, statewide. Note that adoptions usually come with amendments. So, it is important to review those amendments in addition to the unamended model code.

The statewide code includes the 2009 ICC codes (IBC, IEBC, IFGC, IECC, and IMC). The village provides certain grandfathered ordinances (variances to the CBC). An ordinance that is grandfathered has passed the requirements laid out by the Legislature in Wisconsin Statute §101.02(7r)(b). The 2009 IEBC is made part of the Commercial Building Code, subject to the modifications specified in the Wis. Adm. Code § SPS 366.
